These Terms of Service (“Terms”) govern your use of the SMS messaging services operated by 121 Innovations Inc (“we,” “our,” or “us”). By using our services, including by initiating a phone call to our business number or replying to our SMS messages, you agree to these Terms.
1. SMS Messaging Program
Program Name: 121 Innovations Customer Care SMS (also referred to as the HIE DEFT SMS program)
Program Description: An automated SMS responder for missed calls. When you call our business phone number and the call is unanswered, our system sends an SMS to acknowledge the missed call and conduct a brief lead qualification conversation. The conversation typically asks for your name, the service you need, your budget range, and your timeline, so that the business owner can return your call prepared.
2. How to Opt In
You consent to receive SMS messages from us by initiating a phone call to our business phone number. Your act of calling the business and providing your phone number through that call constitutes prior express consent to receive responsive SMS messages, as recognized under the Telephone Consumer Protection Act (TCPA) prior business relationship doctrine.
3. How to Opt Out
You can opt out of our SMS program at any time by replying STOP to any message you receive from us. After replying STOP, you will receive one final confirmation message and no further messages will be sent.
4. How to Get Help
You can request help by replying HELP to any message. We will respond with our contact email and instructions for opting out.
5. Message Frequency
Message frequency varies based on your responses. A typical qualification conversation involves 3 to 6 messages exchanged between you and our system. You will not receive messages outside of an active conversation initiated by your call.
6. Message and Data Rates
Standard message and data rates from your wireless carrier may apply to messages you send and receive. We do not charge a fee for the SMS service, but your carrier may charge for the messages depending on your plan. Contact your wireless carrier for details about your messaging plan.
7. Supported Carriers
Our SMS program supports all major U.S. wireless carriers, including but not limited to T-Mobile, AT&T, and Verizon. Service availability may vary based on carrier and location.
8. Privacy
Your use of our SMS program is also governed by our Privacy Policy.
9. Eligibility
You must be at least 18 years old to use our SMS program. By using our service, you represent and warrant that you are at least 18 years old.
10. Prohibited Use
You agree not to use our SMS program to transmit any unlawful, harmful, threatening, defamatory, obscene, harassing, or otherwise objectionable content, or any content that violates any law or regulation.
11. Disclaimer of Warranties
Our SMS program is provided “as is” without warranties of any kind. We do not guarantee that messages will be delivered in a timely manner or that the service will be free from errors or interruptions.
12. Limitation of Liability
To the maximum extent permitted by law, 121 Innovations Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our SMS program.
13. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date at the top of this document will reflect any changes. Continued use of our services after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.
